Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of 4evahorny.com (the “Site”) and to every order you place with 4evahorny (“we”, “us”, “our”). By using the Site or placing an order you agree to these Terms, our Refunds and Returns Policy, our Shipping and Delivery page and our Privacy Policy. If you do not agree, please do not use the Site or place an order.

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where a clause would otherwise do so, it applies only to the extent permitted by law.

1. Who we are

4evahorny is an online adult wellness store operated from Queensland, Australia. ABN: [ABN TO BE ADDED]. You can reach us through our Contact page.

2. Adults only (18+)

  • The Site contains adult products and is intended only for people aged 18 or over. By entering the Site or placing an order you confirm that you are at least 18 years old.
  • We may cancel any order, or ask for proof of age, where we reasonably believe the buyer or recipient is under 18.
  • Products are sold for lawful adult personal use only.

3. Eligibility and accounts

  • Available delivery destinations are shown at checkout.
  • You are responsible for keeping your account login secure and for all activity under your account.
  • We may suspend or close an account, or refuse an order, where we reasonably suspect fraud, abuse, a breach of these Terms, reselling in commercial quantities, or repeated unfounded claims or chargebacks.

4. Products, descriptions and pricing

  • We take care to describe and photograph products accurately. Minor variations in colour, packaging and supplier batches can occur and are not, on their own, a fault. Measurements are approximate unless stated otherwise.
  • Materials vary by product. Check each product page for its materials, care instructions and warnings, especially if you have allergies or sensitivities (for example to latex).
  • All prices are in Australian dollars (AUD). The total price, including GST and delivery, is shown at checkout before you pay.
  • If a product is listed at an obviously incorrect price or with obviously incorrect details due to a genuine error, we may cancel the order before dispatch and refund you in full.
  • Product availability is not guaranteed until your order is dispatched.

5. Orders and acceptance

  • Your order is an offer to buy. A contract is formed when we dispatch your order. An order confirmation email is an acknowledgement, not acceptance.
  • We may decline or cancel any order before dispatch, including where an item is unavailable, payment fails or is suspected to be fraudulent, or there is a pricing error. If we cancel, we will refund any amount you paid in full.
  • Cancellation requests are covered in our Refunds and Returns Policy (12-hour window).

6. Payment

  • Payment is taken in full at checkout through the providers shown at the payment step. We do not store your full card details.
  • You confirm you are authorised to use the payment method you provide.
  • Promotional codes are single-use unless stated, cannot be combined unless stated, have no cash value, and may be withdrawn at any time.

7. Shipping and delivery

  • Orders are sent in plain, unbranded packaging. Delivery times are estimates only. See our Shipping and Delivery page.
  • You must provide a complete and accurate delivery address.
  • Title and risk in goods pass to you on delivery to the address you provided.

8. Returns and refunds

Returns and refunds are governed by our Refunds and Returns Policy. In summary: no refunds for change of mind, and hygiene and intimate products cannot be returned once opened. Faulty, damaged, wrong and not-as-described items are always handled under the Australian Consumer Law.

9. Safe use of products

You must use products in line with their instructions, labels and warnings, and for their intended purpose. Clean products before and after use as directed, use a compatible lubricant, and stop using a product if you feel pain or irritation. Seek medical advice if you have a health condition, are pregnant, or are unsure whether a product is suitable for you.

10. Limitation of liability

  • To the extent permitted by law, and subject always to your rights under the Australian Consumer Law, we exclude all other warranties, conditions and representations not expressly set out in these Terms.
  • To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or opportunity, except where that loss was reasonably foreseeable and is recoverable under the Australian Consumer Law.
  • We are not responsible for delays or failures caused by events beyond our reasonable control, but this does not remove your ACL rights.

11. Site use and content

  • All Site content is owned by or licensed to us. You may not copy, reproduce, scrape or commercially use it without our written permission.
  • Some images and written content on the Site are created or edited with the help of artificial intelligence (AI) tools. Product photos supplied by manufacturers show the actual products.
  • You must not misuse the Site, including attempting to gain unauthorised access, introducing malicious code, or using automated tools to scrape data or place orders.
  • If you submit a review or other content, you grant us a non-exclusive, royalty-free licence to use and display it in connection with our store. We will not edit reviews in a way that misrepresents them.

12. Changes to these Terms

We may update these Terms by publishing a new version on this page. The version in force when you place an order applies to that order.

13. Disputes and governing law

  • Please contact us first through our Contact page so we can try to resolve any issue directly.
  • These Terms are governed by the laws of Queensland, Australia. This does not limit your right to contact a consumer protection agency (such as the Office of Fair Trading Queensland or the ACCC) or to bring a claim in your home state.

14. General

If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest remains in effect. Our failure to enforce a term is not a waiver of it.
